| 内容記述 | It is an essential goal of the study of medieval history to decide whether the Staatliche is universal in itself, or it is something historical that especially developed in Modern Ages; for the study of medieval study, if the Staatliche is universal, we should regard the social order as the one produced by the Staatliche. If the Staatliche is not universal, however, we cannot help noticing the proper principle of the social order in Middle Ages different from the one in Modern Ages. Now, I'll introduce you two scholars G. v. Below (1858~1927) and O. Brunner (1898~ ), who have opposite opinions in their books: Der deutsche Staat des Mittelalters, 2. Aufl., 1927, Leipzig and Land und Herrschaft, Grundfragen der territorialen Verfassungsgeschichte S?dostdeutschlands im Mittelalter, 2. Aufl., 1943, Wien, and I have tried to compare their opinions in this paper. G. v. Below asserts that the Staatliche is the universal affair and the Staatliche in the Middle Ages is succeeded by the Modern Ages. On the other hand, O. Brunner maintains that in the Middle Ages there was the proper principle of the social construction, apart from the modern state. As this paper tells you, I compared both scholars' conceptions as that of Gerichtsbarkeit, Fehde, Friede and that of Volk. I think that these different conceptions are the opposite points of not only the two scholars, but the two currents of german schools. | |||||||||
